Since 2024, renting out homes for short stays for tourism purposes in Turkey has been subject to a dedicated legal framework. Property owners who plan to list on platforms such as Airbnb need to know its main lines. Below we summarise the general picture.
What does the regulation cover?
The core text on this subject is Law No. 7464 on Renting Housing for Tourism Purposes and Amendments to Certain Laws. The law was published in the Official Gazette on 2 November 2023, and the implementing regulation was published on 28 December 2023. The rules entered into force on 1 January 2024.
As reported in a law firm's summary, the law defines renting housing for tourism purposes as renting a home for any purpose for a period of up to 100 days. Within this framework, anyone who wants to rent in this way must obtain a permit certificate from the Ministry of Culture and Tourism.
The logic of the permit certificate
- The principle is that the permit certificate must be obtained before a rental contract for tourism purposes is made.
- According to the Ministry's relevant page, applications are made through e-Devlet, the Turkish e-government portal.
- If a building has more than one independent unit, the approval of the unit owners required by the law is an important part of the process. The details are covered in a related article in this series.
- According to a law firm summary, the approval of the other owners may not be required for "high-quality homes" whose building management plan allows short-term rental and which provide certain services.
- The same summary reports that subletting based on a permit certificate is in principle prohibited, and that a landlord may obtain certificates for more than one apartment, provided a certain share of the building is not exceeded.
The role of intermediary platforms
The law places obligations not only on property owners but also on intermediaries and on platforms providing e-commerce or promotion services. According to the information reported, intermediary service providers that do not remove an unpermitted listing within a set period after the Ministry's notice may face administrative fines.
Administrative sanctions
The law provides for administrative fines for renting without a permit and for permit holders who fail to meet their obligations. Because amounts and application conditions can change, always check current figures with official sources.
Recent changes to the regulation
- July 2024: An amendment to the regulation introduced separate rules for homes with timeshare rights and widened information sharing among the relevant institutions, travel agencies and intermediary service providers.
- October 2025: As reported by a law firm, the amendment dated 10 October 2025 left the decision on whether to issue a permit certificate to the Ministry's discretion. It also stated that the certificate will be issued per independent unit and will be non-transferable, that no certificates will be issued in areas within the shoreline edge line, that homes with a permit will be inspected twice a year, and that the certificate will be cancelled if a deficiency found is not remedied within 15 days. A smoke detector requirement was also introduced.
What did the Constitutional Court say?
An administrative court had applied for annulment of the wording in the third paragraph of Article 3 of the law that limits the approval requirement in housing complexes to the relevant building only. In its decision dated 25 December 2025 (Official Gazette: 2 April 2026), the Constitutional Court largely rejected the objection; in other words, it did not find the wording contrary to the Constitution.
Practical consequences for owners
- Before opening a listing, check whether your property is eligible for a permit certificate.
- Clarify the position of your building and its unit owners.
- Follow post-certificate obligations (inspection, notification, safety equipment).
- Keep watching current official sources as the legislation changes.
Frequently asked questions
